SEVERSON, Justice.

[¶ 1.] The State charged Michael Clements with bigamy. The trial court dis missed the information against Clements, concluding that bigamy is legally impossible to commit in South Dakota. The State appeals the dismissal. We reverse and remand.

BACKGROUND

[¶2.] The facts in this case are undisputed. Michael Clements married Kristi Anderson in Ashley, North Dakota on December 6, 2009. Anderson filed for divorce from Clements on April 15, 2011.
