KRUEGER, JUDGE.

The appellant was tried and convicted of the offense of theft of property over the value of $50, and *461his punisment assessed at confinement in the State penitentiary for a term of 6 years.

The testimony adduced upon the trial shows that on the night of November 18, 1933, an automobile was stolen from Roy Snodgrass while parked in the driveway of his home in the town of Floydada.
