As appears from the foregoing statement of facts the case is for an accounting to the plaintiff as the surviving partner of James Caveney, deceased, by the administrator of the estate of James.
The books of the partnership, as kept under the direction of James, show the interest of James in the partnership to be an equity in the partnership at the date of his death of $8,953.49, plus a $16,000 note of the partnership to him, as against an equity of $6,756.08 in the surviving partner.
