MEMORANDUM

WARRINER, District Judge.

This cause of action is before the Court for determination on the merits. The parties waive the right to call witnesses or present oral testimony and agree to a decision on the record, that is on the pleadings, stipulations of fact, discovery and exhibits.

Plaintiff Secretary of Labor is proceeding under the Fair Labor Standards Act of 1938, as amended, 29 U.S.C. § 201 et seq. [hereinafter the Act]. Defendants Mr. and Mrs. James J. Clark, as co-owners of a restaurant establishment, are accused of violating the Act’s minimum wage, overtime wage, work records…
