' This case comes here on exceptions before sentence. Respondent was convicted of having, on December 17, 1898, embezzled and fraudulently converted to his own use $250 of the goods and chattels of another, contrary'to the provisions of 3 Comp. Laws, § 11570. No attempt has been made by counsel for appellant to comply with Rule 40 of this court. His brief contains no statement of the facts, nor of the errors upon which he relies, of the questions involved, or the manner in which they are raised.
