MEMORANDUM AND ORDER

MILLER, District Judge.

Plaintiff Jacob Johnson, Jr. brought this action under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., alleging that the defendants discriminated against him because of his race. The defendants seek dismissal under Fed.R.Civ.P. 12(b)(1), claiming that Mr. Johnson failed to file his complaint within ninety days after receipt of his right-to-sue letter from the Equal Employment Opportunity Commission (“EEOC”). 42 U.S.C. § 2000e-5(f)(l).
