OPINION
SETO, Judge.
In this military pay case, defendant has moved the court for summary judgment on the grounds that plaintiff's claim is time-barred by the doctrine of laches and must be dismissed. In the alternative, defendant contends that summary judgment should be entered in its favor because the Army Board of Correction of Military Records (ABCMR or Board) was not arbitrary, capricious, without substantial evidence or contrary to law in its refusal to correct plaintiff’s military record and grant other relief sought.
