¶1 Robbie Prindel (Prindel), who was stabbed by Richard Russell (Russell) on December 30,1998, sued Ravalli County, alleging that the county was negligent when, on December 28, 1998, it failed to admit Russell to the Ravalli County Jail pursuant to a district court order. Both parties moved for summary judgment, and the District Court granted summary judgment in favor of Ravalli County, concluding that as a matter of law the County did not have a duty to prevent Russell from harming Prindel.
