ROBERTS, Justice.

Appellant, a licensed “skilled nursing facility” participating in the medical assistance program established by Title XIX of the Social Security Act 1 and Article IV of the Public Welfare Code, 2 challenges a “reimbursement ceiling” of the Pennsylvania Department of Public Welfare. Without first directly petitioning the Department, appellant filed a “Petition for Review” in the Commonwealth Court, claiming that the ceiling contravenes federal law by basing a facility’s entitlement to reimbursement on the availability of funds, and not on a “reasonable cost…
