It is to be noted that the petition declared on . the lease made by the Sanford Building Company to the appellant, • charging that by mesne conveyances respondent succeeded to all the rights of that company under said lease, is entitled to all the rent accrued and accruing therefrom from the first day of December, 1899, and that defendant attorned to him and paid rent to him as trustee under said lease.
