This case concerns unwanted telemarketing calls and the technology used to make those calls. Plaintiffs-Brian Richardson, Michelle Hunt, Jacqueline Bowser, Kris Villiger, and Donna Schley-are five individuals who received promotional calls from a firm advertising Verde Energy USA, Inc.'s ("Verde") low-priced electricity. Plaintiffs now propose two nation-wide class actions against Verde claiming those calls violated various provisions of the Telephone Consumer Protection Act of 1991 (TCPA), 47 U.S.C. § 227, which regulates over-the-phone marketing.
