In the spring of 1892 the school district defendant decided to introduce free text-books into the public schools. In pursuance of this decision a list of school books needed was made out and bids were asked for from book dealers, giving the terms on which they would supply the books needed. The plaintiff was the successful bidder, and a contract was agreed upon and reduced to writing.
