George O. Altgelt sued Charles X. Gutzeit, county commissioner for precinct No. 2 of Besar county, and Peter P. Hoefgen, county treasurer of Besar county, seeking to restrain the payment to said Gutzeit of a salary of $200 per month, which it was alleged had been paid him, and, unless enjoined, would continue to be paid him, under the provisions of a special act of the Legislature approved March 24, 1913, known as the “Besar County Boad Law,” the title of which act was recited.
