MEMORANDUM OPINION

BLACKBURN, District Judge.

Currently before the court is the motion of defendant Eastman Chemical Company (“Eastman”) for summary judgment on Counts One through Seven of the Complaint 1 and on Eastman’s motion to strike portions of the materials submitted by Robbins in opposing Eastman’s motion for summary judgment. Upon consideration of the record, the submissions of the parties, the argument of counsel, and the relevant law, the court is of the opinion that the motion for partial summary judgment is due to be granted and that the motion to strike is due to be denied.
