PLAGER, Circuit Judge.
This is a patent infringement suit by Jerome H. Lemelson alleging infringement by Mattel’s ‘Hot Wheels’ toy. Over $70,-000,000 in damages and interest was awarded Mr. Lemelson (Lemelson). Defendant Mattel, Inc. (Mattel) appeals from the judgment entered, after a jury trial, by the United States District Court for the Northern District of Illinois, Eastern Division, dated May 8, 1990. 1 The District Court, pursuant to jury verdict, adjudged Mattel to have infringed claim 3 of Lemelson’s reissue patent, Re. 32,106, and awarded jury-determined damages plus interest.
