Affirming.
Indicted for the murder of Tom Byrd, Everett Murphy has been found guilty and his punishment fixed at life imprisonment. By this appeal he is seeking a reversal of the judgment, the grounds assigned and argued for reversal in substance being: (1) That the instructions given were erroneous and prejudicial; (2) that members of the jury were permitted to separate after being placed in the custody of the sheriff and were not kept together as required by law, but were permitted to engage in conversation with persons not members of the jury and…
