MEMORANDUM OPINION
CHARLES R. RICHEY, District Judge.
I. INTRODUCTION
This case is before the Court on defendants’ motion for summary judgment or to dismiss, and plaintiff’s motion for summary judgment. Since there is no genuine dispute as to the facts material to the disposition of this case, summary judgment is appropriate. For the reasons more fully set forth below, the Court grants summary judgment to defendants on the first, third and fifth claims of plaintiff’s complaint.
