LOONEY, Justice.

The two appeals, styled and numbered as shown, were taken from the same judgment, were submitted together, and will be disposed of in one opinion.

Meserole Brothers sued the City of Dallas, its Mayor, Building Inspector and members of the City Council, seeking a mandatory injunction for the issuance of permits authorizing the construction of four commercial buildings, two already under construction and two in contemplation. Upon trial without a jury, the court rendered judgment granting the relief sought as to the two buildings under construction, but refused the relief sought…
