KEITH, Justice.

Defendant below appeals from an adverse judgment rendered in a bench trial and we will designate the parties as they appeared in the trial court.

During the period March 1, 1973, to August 15, 1973, (according to plaintiffs’ allegations) defendant employed the individual plaintiffs to perform work for it in Jefferson County. Before such work was performed, defendant had agreed to be bound by the terms of the collective bargaining agreement then in effect between the plaintiff local union and the employers’ representatives in the area.
