This suit was brought by appellee to partition certain' real estate and quiet his title thereto. On request, the court made a special finding of facts and stated its conclusions of law thereon, which were in favor of appellee. *171Appellant’s motion for a new trial was overruled, judgment was rendered on the conclusions of law, and this appeal was taken.
