The defendant 'Continental Casualty Company appeals from an order denying its motion for a new trial and from a judgment entered for the plaintiff.

The defendant John Van Nice entered into'a written contract on April 7, 1928, with the Christian Reformed Church of Hull, N. D., for the construction of a church building.
