Appeal by the defendant from a judgment of the County Court, Orange County (Byrne, J.), rendered August 3, 1989, convicting him of criminal possession of a controlled substance in the fourth degree and criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

The defendant asserts that the trial court erred when it instructed the jury that a trial is a search for the truth. This contention is not preserved for appellate review (CPL 470.05 [2]; People v Whalen, 59 NY2d 273; People v Nuccie, 57 NY2d 818). In any event,…
