Pending before the court is the Motion To Disqualify filed by defendant, Beverly Health and Rehabilitation Services, Inc., d/b/a Gulf Coast Convalescent Center (“BHRS”) (Doc. 34) and its supporting brief (Doc. 35). Plaintiffs counsel, Charles H. Sinclair (“Sinclair”) has filed a memorandum in opposition to the motion to disqualify (Doc. 46). On April 26, 1999 the court ordered that an evidentiary hearing was necessary in order to make a further inquiry regarding the allegations supporting the request for disqualification (Doc. 49).
