Plaintiffs, Steven W. Sabasta and Sioux Falls Insulation Supply, Inc. (referenced collectively hereinafter as “Plaintiff’ 1 or “Sabasta”), filed the present action for patent infringement on April 17, 2006. Clerk’s No. 1. Plaintiffs Complaint alleges that Sabasta is the original inventor of a roll-bending die used to make saddles for pipe insulation. Compl. ¶ 2.
