SOPER, Circuit Judge.

*731In the bankruptcy proceedings of Abraham Rosenstoek and Abraham Rosenstoek, Inc., the validity of a distraint on the stock of goods situate on premises leased by Ros-enstoek was questioned. The distraint hdd been issued by reason of his failure, as tenant of the premises, to pay taxes thereon in accordance with the covenants of the lease, and it was held by the District Court, in an opinion reported as In re Rosenstoek, 1 3?. Supp. 830, that the distraint was unauthorized under the terms of the lease.
