The plaintiff in error, George Foster, was convicted at the July, 1912, term of the district court of Cleveland county of manslaughter in the first degree, and his punishment fixed by the court at imprisonment in the state penitentiary for a period of eighteen years. The information charged the accused with the murder of Eugene Edward Greenhaw in Cleveland county on the 6th day of December, 1911. The deceased was engaged in the livery business at Norman.
