We are asked to determine whether during the pendency of an appeal from a conviction and sentence for driving an automobile while undér the influence of intoxicating liquor, the Highway Department is authorized to suspend the license of the person so convicted.

Respondent was arrested on November 25, 1952, for driving a motor vehicle while under the influence of intoxicating liquor. He was tried and' convicted in the Recorder’s Court for the Town of Darlington on May 19, 1953.
