Appellant was charged with the theft of a horse from O. T. Cline. When tried, he was convicted, and his punishment assessed at two years’ confinement in the penitentiary.
There are but two grounds presented in the motion for a new trial; the first being that the evidence is insufficient to support the verdict, and the other is that the court erred in not submitting to the jury, at the request of defendant, the issue as to whether defendant had ever before been convicted of a felony, defendant having requested that he do so under the provisions of the law”as passed by the Thirty-Second…
