This matter comes before the court on defendants’ motion for summary judgment. The government’s summary judgment motion raises the five following issues: (1) whether the complaint filed by Pamela Denise Mahomes-Vinson (hereinafter “Ma-homes-Vinson”) states a claim for the negligent release of Nolan Prewett (hereinafter “Prewett”); (2) whether plaintiff’s complaint states a claim for defendants’ alleged failure to control Prewett; (3) whether a plaintiff may recover in excess of $250,000 in a medical malpractice case for “noneconomic loss” and…
