This case comes before us upon a petition and rule to vacate an order of inter-pleader and to dismiss the petition for interpleader.

*515Plaintiff, Samuel D. Clyde, trading as Sweeney and Clyde, a real estate broker, brought this action in assumpsit against defendant, The First National Bank of Chester, to recover a commission alleged to have been earned by plaintiff under an oral contract of employment for the sale of certain real estate owned by defendant.
