This matter, which is before us for the second time, concerns ownership of portions of a “Community Beach” within the Hillsmere Estates Subdivision (the “Subdivision”), located near Annapolis. See Hillsmere Shores Improvement Ass’n, Inc. v. Singleton, No. 763, Sept. Term 2004, 166 Md.App. 756, 762 (filed December 5, 2005) (“Hillsmere I”).
