Appeal from a judgment of the superior court for King county, Albertson, J., entered December 16, 1911, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries sustained in falling on a stairway in a hotel.

Defendant was the proprietor of a hotel, and plaintiff was, on March 81, 1910, and for some time prior thereto had been, a lodger therein. Plaintiff occupied a room on the sixth floor. On the day mentioned, the elevator was out of commission, and plaintiff undertook to go from her room to the ground floor by way of the stairway leading down from floor to floor. The stairway was somewhere near the center of the building, as we suppose, not having the drawings to which the witnesses referred when upon the stand.
