This action was brought by the plaintiff, Grace Allen Jones, against the defendants, Jesse Allen and' Lizzie Allen, for the recovery of certain land in- Creek county allotted to her father, Abraham Allen, for rents, and for the cancellation of certain deeds alleged to have been procured by the defendants, who were the father and mother of Abraham Allen, by fraud and undue influence, and without consideration, and to have defendants declared trustees for plaintiff as to such lands.
