Ebeoe to review a judgment of tide municipal court of Milwaukee county: A. 0. BRazbe, Judge. Plaintiff in error was informed against for having, in the county of Milwaukee, August 19, 1902, had criminal knowledge of and abused Louisa Heyer, a female child under the .age of fourteen years. Such proceedings were duly had in respect thereto that the accused was found guilty by the verdict of a jury, of assault upon the person named with intent-to commit the crime of rape.

Judgment was rendered accordingly. The writ of error was sued out to review the same.

The questions raised by the errors assigned so far as insisted upon, will he treated in detail and in the order of their presentation in the brief of counsel for plaintiff in error.

I. Did the court err in taking the case off the calendar November 21, 1902 ? That is predicated on these circumstances : Previous to the call of the ease for trial it had been placed upoii the day calendar for that purpose.
