It appears from the agreed case found in the record that on the 22d of September, 1881, J. S. Overmier *58and E. T. O’Neil were merchants and partners, doing business in Parker county, and on that day bought goods to the value of some $1,600, from Sanger Bros., payable December 22, 1881. On the 29th of October, 1881, Sanger Bros, brought suit in Parker county upon the account incurred for these goods, alleging that the defendants resided in that county, and asking and obtaining an attachment, which ivas levied upon goods of Overmier & O’Neil.
