In an action, inter alia, pursuant to RPAPL article 9 for the partition and sale of certain real property and for a judgment declaring that the plaintiff owns an undivided one-half interest in the real property, the plaintiff appeals, as limited by her brief, from so much of an order of the Supreme Court, Kings *838County (Kramer, J.), dated July 5, 2007, as denied that branch of her cross motion which was for summary judgment.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the plaintiffs cross motion which was for summary judgment is granted,…
