Defendant was convicted of first degree murder after a jury trial and sentenced by the court to 40 years’ imprisonment. This court affirmed his conviction and sentence in an unpublished order (People v. McLaughlin, No. 1 — 96—2250 (1997)) (unpublished order under Supreme Court Rule 23). Thereafter, defendant filed a pro se postconviction petition. See 725 ILCS 5/122 — 1 (West 1998).
