This record, which is so full of blunders as to dates that it is difficult to understand just what rights any one has under it, appears to present one or two points in such a way that we can give a reasonably correct guess at what was meant by the referee, although if our conclusions were different from what they are upon the legal propositions argued, we should feel compelled to send the case back for new trial as almost hopelessly muddled. But this much we can infer.
