INTRODUCTION

Plaintiff Apace Communications, Ltd. (“Apace”) brought this action asserting fraud and other claims against a number of defendants, alleging that Apace was fraudulently induced by defendants to invest in a company named NetSetGo.

The Court has issued several decisions in this case, granting plaintiff leave to amend the complaint, 522 F.Supp.2d 509 (W.D.N.Y.2007), granting leave to file a second amended complaint, 584 F.Supp.2d 591 (W.D.N.Y.2008), and dismissing plaintiffs claims against a particular defendant, David Klein. 2009 WL…
