Petitioner, Paul Nye, has filed a petition seeking his release from the State Penitentiary, at McAlester, where he is confined by reason of the judgment and sentence of the district court of Le Flore county, pronounced upon a plea of guilty entered on the 3rd day of February, 1941.
It is alleged in the petition that petitioner is illegally restrained of his liberty as follows:
