MEMORANDUM OPINION AND ORDER

LARKINS, District Judge:

This action is a petition for a Writ of Habeas Corpus brought by a physician who is presently a Lieutenant Commander in the United States Navy stationed at Camp Lejeune, North Carolina.

Petitioner graduated from the University of California, Irvine College of Medicine, in June, 1967. He did his internship at Mount Zion Hospital in San Francisco during 1967 and 1968 where he signed up for the Armed Forces Physician’s Appointment and Residency Program (Berry Plan) and was commissioned as a Lieutenant JG.
