In this case it appears that the defendant was arrested while in Boston, Massachusetts, ,in attendance before a commissioner acting under a commission issued out of the superior court for Cook county, Illinois, to take the depositions' of certain witnesses in a case pending in that court between the same parties, and for the same cause of action as this suit. The defendant submitted to the arrest, and gave bail. The suit was first brought in the state court, and after-wards duly removed here.
