OPINION OF THE COURT

THEIS, District Judge.

Defendants’ motion for summary judgment in this case affords the Court an opportunity to journey back in American history and to close the book on another unsalutary volume in the history of the treatment of the Indian people by the white immigrants to this land. Plaintiffs ask the Court to add a final chapter to this saga that, to the plaintiffs at least, would constitute a happy ending.
