Appeal from an order of the Supreme Court (Zwack, J.), entered January 26, 2007 in Ulster County, which denied a motion by defendant Town of Lloyd for summary judgment dismissing the complaint against it.
This case arises from a motor vehicle accident between plaintiff Monica Russo-Martorana (hereinafter plaintiff) and defendant Deno Theophilakos (hereinafter defendant) at the Y intersection of two rural roads in the Town of Lloyd, Ulster County.
