Plaintiff Roberta Temple (hereinafter plaintiff) was injured in a one-car accident which occurred on County Route 2 in the community of Smithville Flats, Chenango County. According to plaintiff, while driving on that road she swerved to avoid a cat and, in so doing, lost control of her car, veered off the road, went over a steep embankment, struck a tree and landed in a creek. Plaintiff alleges that defendant was negligent in, inter alia, failing to place guiderails or guardrails in the area where her car left the road.
