delivered the opinion .of the court:

Attached to the petition is a copy of a contract between plaintiff and the Government purporting to be a final settlement of matters growing out of three contracts made in 1917, upon a cost-plus basis, for construction work at the Wilbur Wright Field and the McCook Field in Ohio, as well as a settlement of claims duly presented to the Secretary of War under the terms of the Dent Act. This contract ascertains the balance due the plaintiff to be a stated amount, which plaintiff agrees to accept and the defendant agrees to pay in full…
