Writ of entry counting on the seisin of the United States within twenty years, and a dis-seisin by the tenant [William Slade]. Plea, nul disseisin. At the trial, the title of the United States appeared to be under an execution dated the 10th of April, 1805, and issued on a judgment recovered by the United States against one John Bowers, the owner of the land, at the March term of the district court of Massachusetts district, A. STORY, Circuit Justice.

The statute of Massachusetts of the 17th of March, 1784, enacts, that when any judgment creditor shall think proper to levy his execution on his debtor’s real estate, the officer to whom it is directed shall cause three disinterested and discreet freeholders in the county where the land lies, one to be chosen by the creditor, one by the debtor, and a third by the officer; and in case the debtor shall neglect or refuse •to choose, the officer shall appoint one for the debtor, to be sworn before a justice of the peace for the county, faithfully and impartially to appraise…
