This appeal is chiefly concerned with the proper interpretation of a judgment rendered in the district court of Russell county in an action for breach of a bailment contract covering some 3,500 bushels of wheat which plaintiff had in storage with the Farmers Elevator Company, of Luray, in June, 1924. Plaintiff’s wheat was not forthcoming on demand; shortly thereafter the elevator burned, and plaintiff sued the elevator company for its value.
