[¶ 1] Cynthia Molleur appeals from a summary judgment entered by the Superi- or Court (York County, Brennan, J.) in favor of Dairyland Insurance Company. Molleur argues that the Superior Court erred in granting summary judgment and in denying her motion for partial summary judgment because the offset provision of an insurance policy under which she was insured, operating to offset any underin-sured motorist payments by the amount paid out under the liability coverage of the same policy, is contrary to the public policy stated in 24-A M.R.S. § 2902 (2007). 1 We agree and vacate the decision of…
