Plaintiff, Director of the Division of Insurance, Department of Economic Development, State of Missouri (the “Division of Insurance”), brings this action in his capacity as Receiver for Transit Casualty Company (“Transit”), an insolvent Missouri insurance company, alleging that Defendant J. Henry Schroder Bank & Trust Company (“Bank”), a New York based bank, wrongfully dishonored sight drafts on two letters of credit it had issued in Transit’s favor.
